This membership agreement and its annexes, including the privacy policy, marketplace agreement and distance sales agreement, contain the necessary rules and conditions to benefit from the services offered on our website.

Parsana, Boğazköy Sk, 42250 Selçuklu/Konya Konya, hereinafter referred to as “aloyemek.com”, acts as an “INTERMEDIARY” in this agreement.

In order to benefit from the services offered on www.aloyemek.com, users must become members of the site as buyers or sellers. Membership can be completed by filling out the user registration form or by registering via social media networks such as Facebook, Google, etc. through www.aloyemek.com.

Every aloyemek.com user agrees and undertakes to comply with the provisions of this User Agreement concluded with aloyemek.com.

Each user who becomes a member accepts that upon approval of their membership, they have read, understood and approved all the provisions of the membership agreement and its annexes. aloyemek.com provides its members who approve the agreement with the opportunity to order food online and sell food to buyers.

PARTIES

This aloyemek.com Aloyemek E-commerce services agreement has entered into force electronically between aloyemek.com website and users who are members as sellers or buyers. This Membership Agreement shall enter into force upon the buyer or seller becoming a member of the site.

DEFINITIONS

The expressions, definitions and abbreviations contained in this Membership Agreement shall have the meanings stated opposite them. aloyemek.com refers to all websites and applications through which services are provided, including the domain name aloyemek.com and its subdomains and mobile applications.

Member: Refers to all users registered on the site as seller members or buyer members.

Buyer Member: Refers to real or legal persons who become members of the site in order to purchase a product of their choice and benefit from the opportunities offered to members.

Seller Member: Refers to real or legal persons who become members of the site in order to create products needed by buyer members and benefit from the opportunities offered to members.

Food & Grocery Menus: Refers to the menus offered for sale by seller members (food varieties, beverages, desserts, grocery products, etc.).

Membership Package Models

1. Subscription Package: Businesses do not pay commission fees, package fees or system setup fees until 01.01.2023. They continue to use the system free of charge. They may become members of aloyemek.com. In this membership model, no commission rate is deducted and no package fee is charged until 01.01.2023. Unlimited menu entry and unlimited sales are allowed, and sales are made only with the cash on delivery option. As of 01.01.2023, aloyemek.com will continue its operations with commission and package sales.

Article 1: SUBJECT, SCOPE AND ACCEPTANCE OF THE AGREEMENT

Subject of the Membership Agreement

The subject of this membership agreement is to determine the membership conditions, the terms of benefiting from the products offered for sale on the site, and the obligations of the parties. Scope of the Membership Agreement The scope of this agreement includes the provisions specified in the agreement and its annexes, as well as warnings, notices, texts or explanations regarding usage, membership and services shared by aloyemek.com on the site.

Acceptance of the Membership Agreement

By becoming a member of the site, the user is deemed to have accepted the Membership Agreement, its annexes, and all notices, texts or explanations regarding usage, membership and services shared by aloyemek.com on the site. The member agrees to act in accordance with all matters stated in these declarations while using the site.

MEMBERSHIP AND SITE USAGE CONDITIONS

An aloyemek.com member will have a “Username” and “Password” determined by themselves. The username is unique to the member and the same username cannot be assigned to two different members. aloyemek.com informs users only about campaigns available in their region via email, SMS or mobile notifications. The password is known only to the user. The user may change their password at any time. The selection and protection of the password is entirely the user's responsibility. aloyemek.com is not responsible for any problems arising from password usage. To access services requiring aloyemek.com membership, users must enter their username and password. This process is referred to as “Login” on aloyemek.com. Only individuals over the age of 18 may become members of the site.

RIGHTS AND OBLIGATIONS

USERS' RIGHTS AND OBLIGATIONS

The member accepts that all responsibility arising from incorrect or incomplete information provided during registration belongs to them, that the security of their username and password is their responsibility, and that aloyemek.com has no liability for damages arising from unauthorized access, misuse, or third-party actions due to the user's negligence.

PRODUCT PAYMENTS

aloyemek.com cannot be held responsible for payments made outside the platform (cash on delivery, bank transfer, etc.). The member agrees that payment must be made upon delivery of the product, otherwise the product may not be delivered.

AUTOMATIC ORDER CANCELLATION

Orders must be approved, rejected or accepted by sellers within the specified time through the business management panel. Orders not responded to within the specified time (e.g. 5 minutes) are automatically canceled by the system. By registering on aloyemek.com, buyers and sellers accept this condition. aloyemek.com cannot be held responsible for any damages arising from automatic order cancellations.

SELLER MEMBERS' RIGHTS AND OBLIGATIONS

Seller members may sell legally compliant food and beverage products. The seller is responsible for delivering the order to the buyer. aloyemek.com cannot be held responsible for disputes arising between buyers and sellers. All tax obligations related to online sales belong to seller members.

BUYER MEMBERS' RIGHTS AND OBLIGATIONS

The buyer member accepts that all legal responsibility for purchased products belongs to them and that aloyemek.com has no direct or indirect responsibility. Buyer members cannot claim compensation from aloyemek.com for any damages arising during the delivery process.

ALOYEMEK.COM'S RIGHTS AND OBLIGATIONS

aloyemek.com may temporarily suspend or permanently stop system operations at any time without liability. aloyemek.com owns all intellectual property rights related to its services and content.

VALIDITY OF ALOYEMEK.COM RECORDS

In disputes arising from this agreement, aloyemek.com records shall constitute conclusive evidence. Notifications shall be made via the email addresses provided by the parties.

APPLICABLE LAW AND JURISDICTION

Turkish Law shall apply to this agreement. Istanbul Courts and Enforcement Offices shall have jurisdiction over disputes arising from this agreement.

ENTRY INTO FORCE

This agreement enters into force indefinitely upon the user completing registration or using aloyemek.com services.

TERMINATION AND AMENDMENTS

aloyemek.com reserves the right to unilaterally terminate or amend this agreement at any time.
